Curious Antiques is a Norfolk, UK, based antiques trading business owned and operated by Dr Les Parrett. By using this website you are deemed to have read and agreed to these terms and conditions.
   The following terminology applies to these terms and conditions, our Privacy policy statement and any or all agreements: "Client", “Customer”, “You” and “Your” refers to you, the person accessing this website and accepting our terms and conditions. "Curious Antiques”, “The business", “Ourselves”, “We” and "Us", refers to our business. “Party”, “Parties”, or “Us”, refers to both the client and ourselves, or either the client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of providing products and services, in accordance with, and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Product descriptions
Our aim is to ensure that customers are delighted with their purchase(s). To this end we will always represent our items offered for sale as accurately as possible. However, it must be noted that lighting, colour reproduction and a range of other factors can affect the appearance of any image of our merchandise. Antiques by definition are old and used, and invariably display a few ‘honourable scars’ and signs of usage. Indeed, this is often what forms their character – with patination, for example, resulting from years of use. So please do not assume that items are offered in pristine or ‘as new’ condition. We will always highlight any condition factors that we feel go beyond what one would reasonably expect to find in an antique object. Please feel free to ask for additional images and details of condition, etc., for any item, or if you wish to arrange a viewing.

Delivery costs and arrangements
For many items, the cost of delivery has been estimated in advance and is added to the price at the checkout, taking into account the country specified in your delivery address. We can arrange delivery in the UK and worldwide. If you do not wish to pay the estimated delivery charge then please contact us for a bespoke delivery quotation. Our checkout page also allows you to buy online for collection in person or by your representative from one of our Norfolk premises. Selecting the ‘I will collect’ radio button on the Checkout page, will result in the delivery charge being removed automatically from your online order. Note that prices do not include any customs or other charges you may incur if located outside the EU. Multiple deliveries to the same address may attract a delivery charge discount, but you will need to contact us for a quotation. We aim to despatch items within three working days of clearance of payment.

Returns policy
If, for any reason, you are not entirely satisfied with your purchase(s), and you contact us within 14 days of receipt of goods, we will offer a full refund, excluding return postage/carriage. Please note that it is your responsibility to ensure the safe return of the item(s) – i.e. that it arrives in the same condition as when it left Curious Antiques, and for this reason we always recommend that you use tracked and insured postage/carriage.

Customers are offered a number of discounts on this site. Some are usually provided if the order meets minimum requirements. For example, a discount of 10% is generally automatically deducted from the price of the item if the value exceeds £500. This increases to 15% for two or more items purchased at the same time, whatever their value. If these items exceed a total value of £1000, however, then the discount rises still further to 20%.
   Then there are special periodical Sale discounts, which are highlighted in a corner banner on the homepage. These apply on all items for a certain period only, and are again automatically deducted at the Checkout. Thirdly, there are loyalty discounts offered to existing customers on their next purchase. In this case the customer must enter a unique discount code at the Checkout to obtain the discount. And lastly there are ad hoc discount vouchers offered to individual customers. These may be set up to apply to a single item, or the customer's entire cart.
   It should be noted that discount vouchers/codes are non-transferable and may generally be used once only. Discount codes usually have no expiry date. Most discounts are non-cumulative – meaning that only the single highest available discount will apply to any sale, and other discounts will not carry forward.

Exclusions and limitations
The information on this website is provided on an ‘as is’ basis. To the fullest extent permitted by law, we:
  • Exclude all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or our literature; and
  • Exclude all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised us of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
   The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
We accept payment by PayPal account, as well as major credit/debit and charge cards – including Visa, Mastercard, Discover and American Express. We also accept cash, bank transfers and cheques. Please note that you do not require a PayPal account to use the PayPal gateway. Items are not despatched until payment has cleared, and all goods remain the property of Curious Antiques until paid-for in full.
   Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second returned cheque from a customer, we reserve the right to terminate any agreement and insist on cash transactions only.

Copyright and other intellectual property rights exists in all text, images, artwork and designs relating to our services, and displayed on this website, including the Curious Antiques logo. Images on the site for which we do not hold rights are reproduced with the owners’ permissions.
   Except for the purposes of bona fide editorial comment in the media, including online, digital, print and other publications, plus blogs/forums, etc., redistribution or republication of any part of this site or its content is prohibited, including such by framing or any other means, without our express written consent.

We do not warrant that the service from this website will be uninterrupted, timely or error free, although it is provided to the best of our ability. By using this service you indemnify us, our employees, agents, affiliates and partners against any loss or damage, in whatever manner, howsoever caused.

Force majeure
Neither party shall be liable to the other for any failure to perform any obligation under any agreement which is due to an event beyond the control of such party, including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any party affected by such event shall inform the other party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any agreement contained herein.

Failure of either party to insist upon strict performance of any provision of this or any agreement or the failure of either party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any agreement. No waiver of any of the provisions of this or any agreement shall be effective unless it is expressly stated to be such and signed by both parties.

Our failure to enforce any of the provisions set out in these Terms and conditions and any agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and conditions or of any agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and conditions shall not be amended, modified, varied or supplemented except in writing and signed by our duly authorised representative.

Notification of changes
We reserve the right to change these conditions from time to time as we see fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our Privacy policy, we will announce them on that page. If there are any changes in how we use our site customers’ personally identifiable information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our Privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read our statements on a regular basis.
   These terms and conditions form part of the agreement between the client and ourselves. In accessing this website, purchasing a product or service and/or entering into any other agreement you indicate your understanding and acceptance of the full Terms and conditions contained herein. Your statutory consumer rights are unaffected.
